Fitness Waiver
ASSUMPTION OF THE RISKS AND RELEASE: I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and further release and discharge Al'Z Divine Fitness LLC for injury, loss, or damage arising out of my or my family’s use of or presence upon the facilities of Al'Z Divine Fitness LLC whether caused by the fault of myself or other third party.
INDEMNIFICATION: I agree to indemnify and defend Al'Z Divine Fitness LLC against all claims, causes of action, damages, judgements, costs or expenses, including attorney fees and other litigation costs, which may in any way rise from my fault or the fault of a third party in the use of or presence upon the facilities of Al'Z Divine Fitness LLC.
FEES: I agree to pay for all damages to the facilities of Al'Z Divine Fitness LLC caused by any negligent, reckless, or willful actions caused by me.
APPLICABLE LAW: Any legal or equitable claim that may arise from participation in the above shall be resolved under Florida law.
NO DURESS: I voluntary entered into this agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel to review this agreement if I so desire.
Waiver to Exercise Form
12. Al'Z Divine Fitness LLC. is not responsible for any possible or potential injuries, that could occur during exercising. Al'Z Divine Fitness will ensure that each client will execute proper form, technique, and breathing, that will equate to a safe and exciting, workout experience.
