ADULT PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNIFICATION AGREEMENT

This Waiver, Release of Liability, Assumption of Risk, and Indemnification Agreement (“Agreement”) is entered into by the undersigned participant (“Participant”) in favor of ALZ Divine Fitness LLC, including its owners, officers, employees, independent contractors, trainers, agents, volunteers, successors, affiliates, and representatives (collectively referred to as “ALZ Divine Fitness”).

By signing this Agreement, Participant acknowledges and agrees to the following:

 

1. VOLUNTARY PARTICIPATION

Participant voluntarily chooses to participate in fitness training, personal training, group fitness classes, strength training, cardiovascular exercise, high-intensity interval training (HIIT), boot camps, stretching, mobility exercises, wellness coaching, nutritional discussions, and any related fitness activities conducted by ALZ Divine Fitness (“Activities”).

Participant understands that participation is entirely voluntary and may discontinue participation at any time.

2. ASSUMPTION OF RISK

Participant understands and acknowledges that physical exercise and fitness activities involve inherent risks, including but not limited to:

  • Muscle strains and tears
  • Sprains and fractures
  • Slips, trips, and falls
  • Heat exhaustion or dehydration
  • Cardiovascular complications
  • Abnormal blood pressure
  • Heart attack or stroke
  • Serious bodily injury
  • Permanent disability
  • Death

Participant knowingly and voluntarily accepts and assumes all risks, known or unknown, associated with participation in any Activities conducted by ALZ Divine Fitness.

Participant acknowledges that injuries may result from:

  • Physical exertion
  • Use of equipment
  • Negligence of other participants
  • Improper use of equipment
  • Failure to follow instructions
  • Facility conditions
  • Accidental or unforeseen events

3. MEDICAL REPRESENTATION

Participant affirms that they are physically capable of participating in fitness activities and have no medical condition that would prevent safe participation.

Participant understands that ALZ Divine Fitness is not a medical provider and does not diagnose medical conditions.

Participant agrees to consult with a physician prior to participating if they have any concerns regarding their health, including but not limited to:

  • Heart conditions
  • High blood pressure
  • Diabetes
  • Respiratory issues
  • Orthopedic injuries
  • Pregnancy
  • Any other medical condition

Participant assumes full responsibility for monitoring their own physical condition during participation.

4. RELEASE OF LIABILITY

To the fullest extent permitted by Florida law, Participant hereby releases, waives, discharges, and covenants not to sue ALZ Divine Fitness from any and all liability, claims, demands, causes of action, damages, losses, costs, or expenses arising out of or related to:

  • Personal injury
  • Illness
  • Property damage
  • Disability
  • Emotional distress
  • Economic loss
  • Death

whether caused by negligence or otherwise, arising from participation in any Activities or use of the facility, equipment, or services provided by ALZ Divine Fitness.

This release includes claims based upon ordinary negligence of ALZ Divine Fitness.

5. WAIVER OF RIGHT TO SUE

Participant expressly waives any and all rights to bring legal action, lawsuit, arbitration claim, or other proceeding against ALZ Divine Fitness for injuries, damages, or losses arising from participation in Activities, except where prohibited by law.

Participant understands that by signing this Agreement, they are giving up substantial legal rights, including the right to sue.

6. INDEMNIFICATION AND HOLD HARMLESS

Participant agrees to indemnify, defend, and hold harmless ALZ Divine Fitness from and against any and all claims, liabilities, damages, judgments, costs, attorney’s fees, or expenses arising out of:

  • Participant’s actions or omissions
  • Participant’s negligence
  • Participant’s violation of facility rules
  • Injuries caused to other persons by Participant
  • Damage to property caused by Participant

7. EQUIPMENT AND FACILITY USE

Participant agrees to use all equipment safely and as instructed.

Participant acknowledges that misuse of equipment may result in injury.

Participant agrees to immediately notify ALZ Divine Fitness staff of any unsafe conditions, damaged equipment, or injuries sustained during participation.

8. EMERGENCY MEDICAL TREATMENT

Participant authorizes ALZ Divine Fitness to obtain emergency medical treatment if deemed necessary.

Participant understands that they are solely responsible for any medical expenses incurred as a result of participation.

9. NO GUARANTEE OF RESULTS

Participant understands that ALZ Divine Fitness makes no guarantees regarding:

  • Weight loss
  • Muscle gain
  • Athletic performance
  • Physical transformation
  • Health improvement
  • Any specific fitness outcome

Results may vary based on individual effort, consistency, nutrition, genetics, and other factors.

10. PHOTO AND VIDEO RELEASE (OPTIONAL)

Participant grants permission to ALZ Divine Fitness to use photographs, videos, or recordings taken during Activities for marketing, promotional, educational, or social media purposes without compensation.

Participant may revoke this authorization in writing.

11. SEVERABILITY

If any provision of this Agreement is found unenforceable or invalid, the remaining provisions shall remain in full force and effect.

12. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.

Any legal proceeding arising under this Agreement shall be brought exclusively in the State of Florida.

13. ACKNOWLEDGMENT OF UNDERSTANDING

Participant acknowledges that:

  • They have carefully read this Agreement
  • They fully understand its contents
  • They understand they are waiving important legal rights
  • They sign this Agreement voluntarily and without coercion

Participant further acknowledges that this Agreement is intended to be as broad and inclusive as permitted by applicable law.

KIDS FITNESS WAIVER

KIDS SUMMER FITNESS CLASS
LIABILITY WAIVER, RELEASE OF CLAIMS, AND INDEMNIFICATION AGREEMENT

By signing below, I, the parent and/or legal guardian of the participating child (“Participant”), acknowledge and agree to the following terms and conditions related to participation in the Alz Divine Fitness Kids Summer Fitness Class (“Program”).

 

1. ASSUMPTION OF RISK

I understand that participation in physical fitness activities, exercise programs, sports training, games, outdoor activities, and related events involves inherent risks, including but not limited to bodily injury, illness, falls, muscle strains, sprains, dehydration, permanent disability, or death. I voluntarily assume all risks associated with my child’s participation in the Program.

2. RELEASE OF LIABILITY

To the fullest extent permitted by law, I hereby release, waive, discharge, and hold harmless Alz Divine Fitness, its owners, instructors, employees, volunteers, contractors, agents, affiliates, and representatives from any and all claims, liabilities, demands, actions, causes of action, damages, costs, or expenses arising out of or related to any injury, illness, loss, or damage sustained by my child during participation in the Program, including claims allegedly caused by negligence.

3. INDEMNIFICATION

I agree to indemnify, defend, and hold harmless Alz Divine Fitness and its owners, instructors, employees, volunteers, contractors, agents, affiliates, and representatives from and against any and all claims, lawsuits, liabilities, damages, judgments, losses, costs, or attorney’s fees arising from or related to my child’s participation in the Program or any actions brought by or on behalf of the Participant.

4. MEDICAL AUTHORIZATION

In the event of an emergency, I authorize Alz Divine Fitness staff to obtain emergency medical treatment for my child if I cannot be reached immediately. I understand that I am solely responsible for any medical expenses incurred.

5. HEALTH CONFIRMATION

I certify that my child is physically fit and able to participate in the Program activities. I agree to disclose any medical conditions, allergies, injuries, or limitations that may affect participation.

6. NO GUARANTEE OF SAFETY

I understand that while reasonable precautions will be taken to promote safety, Alz Divine Fitness cannot guarantee the safety of participants and is not responsible for unforeseen accidents or injuries.

7. WAIVER OF RIGHT TO SUE

I knowingly and voluntarily waive any and all rights to bring legal action or sue Alz Divine Fitness, its owners, instructors, employees, volunteers, contractors, agents, affiliates, or representatives for any claims arising out of my child’s participation in the Program, except where prohibited by applicable law.

8. GOVERNING LAW

This Agreement shall be governed by and interpreted in accordance with the laws of the State of Florida.

9. PROPERTY DAMAGE RESPONSIBILITY

The parent and/or legal guardian agrees to be fully responsible for any and all damages to the facilities, equipment, property, or premises of Alz Divine Fitness caused by the negligent, reckless, intentional, or willful actions of their child during participation in the Program. The parent and/or legal guardian agrees to reimburse Alz Divine Fitness for the full cost of repair or replacement of any damaged property.

10. ACKNOWLEDGMENT

I have carefully read this Liability Waiver, Release of Claims, and Indemnification Agreement, fully understand its contents, and sign it voluntarily.
